UniSource Energy Services Marketplace Terms & Conditions

All Marketplace Products

•          Purchases must be made by current UniSource Energy Services (UES) residential electric customers.
•          Customers must install products at the address associated with their UES electric account.
•          Products may not be resold.
•          Customers must install all products within 30 days of purchase.
•          Offers, pricing, and available rebates are subject to change without notice.
•          Customers agree to indemnify, hold harmless, and release UES and its affiliates from actions or claims related to the purchase, installation, operation, or disposal of Marketplace products, including liability for incidental, indirect, or consequential damages.
•          Marketplace purchases are sold, processed, shipped, and managed by Franklin Energy, or another UES approved third party provider.    

Product Specific Requirements

LEDs, Room ACs, Showerheads, and Aerators

•          Products must be installed at the customer’s UES served address.
•          Products purchased through the Marketplace are not eligible for additional UES rebates, unless otherwise stated.    

Electric Vehicle Chargers

•          EV chargers must be Level 2 or higher and installed within the current calendar year.
•          The charger must be installed at a single-family residence within UES service territory. (TEP excludes multi family; applied here similarly.)
•          Customers may be required to use a Time of Use (TOU) rate plan for at least two years if participating in a UES rebate program.
•          Chargers must be Wi Fi connected to the customer’s UES account if required for program participation.
•          Customers may receive rebates for up to two chargers per UES account, if applicable.
•          UES may request to verify installation as part of program compliance.    

General Marketplace Information

•          The Marketplace offers energy efficient products, including smart thermostats, LEDs, and other devices, often at prices below standard retail.
•          Product availability, specifications, and pricing may change without notice.
•          Products include only the manufacturer’s warranty, unless otherwise stated.
•          UES is not responsible for installation, product suitability, or product performance.

Warranty

All other goods sold are guaranteed to be free from defects in material and workmanship for a period of 60 days from shipment. Some products may include a longer warranty period; please refer to product packaging or specification on the products’ webpages for more detailed information. Other than this warranty, seller makes no warranty of any kind, express or implied, including any warranty of merchantability, fitness for purpose or otherwise. The seller shall in no event be liable for any incidental, indirect, special or consequential damages of any kind, in contract, tort or otherwise. The seller’s liability and buyer’s exclusive remedy is limited to the replacement of non-conforming products or payment in an amount not to exceed the purchase price of the specific products for which damages are claimed at the option of the seller.
